Da ich die Unzuverlässigkeit des Rechtssystems unterstelle, müssen wie uns andere Lösungen für diese Probleme überlegen. Auch sollten wir versuchen, zu erfahren, ob es sich um EINEN Leerverkäufer handelt, oder um VERSCHIEDENE, die lediglich Spekulieren. Sollte es Einer sein, so ist auch zu klären, ob er Verbindung zum Somare Regime hält, das immer noch gebraucht wird für die Übertragung der Bergbaurechte, der BOC Aktien und der Haushaltsfinanzierung.
Auf die Frage an PC, ob denn mir der Nominee auf legale Weise mein Stimmrecht vorenthalten könne, und ob er mir helfen könne an mein Stimmrecht zu kommen, bekam ich folgende Antwort:
"Dear Mr tom0001,
You will need to instruct the entity you purchased the shares from to
have the nominee company issue you with a proxy for the number of shares
you hold to be able to vote at the AGM as your name does not appear on
the register. You have a right as the owner of the shares to instruct
your broker to do so. Unfortunately only your broker can instruct the
nominee company to issue the proxy to vote.

Das heißt also ich muss meine Bank damit beauftragen, das Recht habe ich, den Nominee anzuweisen, dass er mir eine Vollmacht über die Aktien die ich gekauft habe, aber die im Namen des Nominees im Aktienbuch stehen, zu erteilen, damit ich an der HV teilnehmen kann.
Wobei aber meine Bank sagt, dass der Lagerstelle genau das nicht möglich ist.
Das selbe Problem wird also jeder haben, der nicht im Aktienbuch steht.
Oder sehe ich das falsch?
Wer die ESBC stärken will,bzw. den möglichen short-squeeze mit auslösen will sollte seine Bank anschreiben.

Papua New Guinea Prime Minister Michael Somare has been found guilty of 13 charges of misconduct in office for submitting annual financial statements late or incomplete.
A three-member tribunal sitting in Port Moresby handed down its decision on Monday afternoon and will reconvene on Tuesday to hear recommendations for an appropriate penalty.
Somare, 74, who has been at the forefront of PNG politics for 40 years, will remain in the top job and is expected to be punished only with a small fine.

Tribunal chairman Roger Gyles told the packed courtroom Somare was guilty of eight charges relating to filing incomplete financial statements as is required under PNG's leadership code.
Somare was also found guilty on five charges related to providing late records, Mr Gyles said.
But Somare escaped the three more serious charges of failing to provide any statement at all.
The tribunal also dismissed nine charges as irrelevant from the original 25 against the PM that dated back as far as 20 years ago.
Monday's brief session, during which Mr Gyles read out the tribunal's findings, is the fifth day of a hearing that began on March 10 after months of controversy and political rumblings.
Since 2008, Somare had tried to block the tribunal through the courts and late last year his lawyers made an unsuccessful bid for the Supreme Court to stop the proceedings due to bias and procedural flaws.
Somare told the court last week he had lodged his returns every year and suggested staff might have lost some records that were missing from the Ombudsman Commission.
But the commissioner who initiated the original investigation argued that Somare had failed to lodge or did not lodge complete forms or did so late and thus breached his responsibility as prime minister.
Every day of the trial the packed courtroom has been a who's who of PNG's political elite, with at times the country's entire cabinet present to support the prime minister.

AUTONOMOUS Bougainville Government President James Tanis and his delegation are in Port Moresby for the final Joint Supervisory Board meeting which will be held this week.
The delegation which comprises ABG ministers and administration officials left for Port Moresby yesterday.
Their trip to the final JSB meeting shows the ABG’s commitment to pursue outstanding issues on autonomy implementation to the drawdown of powers and functions on priority subject matters.
The Bougainville Executive Council on Tuesday approved the implementation of stage three of the revised indicative steps on the transfer of functions and powers relating to mining, oil and gas with regard to the review of the Bougainville Copper Agreement (BCA).
President Tanis said the ABG would put a request to the National Government to start the process of the review adding that the ABG was ready to start negotiation of the BCA.
“What is now required to be done on the ground is to attend to the landowners’ reconciliation, election of the landowners executives, social, environmental, land and other outstanding issues be fast-tracked in preparation for the landowners participation in the review,” said Mr Tanis.
