Die heutige Rede is ja nur eine von vielen Faktoren, die den Kurs
in Bewegung setzen könnten.
NEW YORK, Oct 21, 2003 (BUSINESS WIRE) -- Universal Express, Inc. (OTCBB: USXP)
announces CEO Richard Altomare is in Washington DC on the eve of a meeting
convened by the SEC to address naked short selling. Altomare is lobbying members
of Congress suggesting positive solutions to the naked short selling issue.
Universal Express, one of thousands of companies that are victims of naked short
selling, describes it as the electronic churning downward of shares of
developing OTCBB companies by broker dealers and market makers who never intend
to or fail to cover short sales. USXP contends that this practice amounts to
counterfeiting stock and is separate and distinct from legitimate short selling.
The SEC outlawed most naked shorts in 1936 and because of recent pressures plans
to consider a new Regulation SHO on Wednesday, October 22, at its 10 a.m.
meeting. The new Regulation SHO is expected to require short sellers in all
equity securities to locate securities to borrow before selling short, and add
further requirements to address "naked" short selling.
Richard Altomare recommends the following actions be endorsed by Congress and
the SEC:
-- The SEC immediately enforce all existing laws pertaining to
shorting in the 1933 and 1934 Securities
-- Anyone outside the U.S. requesting access to U.S. Securities
Markets must agree to comply in full with U.S. securities and
market laws, rules and regulations.
-- Rules prohibiting Sale of Unregistered Securities must be
rigorously enforced. Naked shorting is such a violation.
-- Any short sale must be done only after an "Affirmative
Determination" is made regarding the ability of the trader to
borrow the shares sold short for delivery within 3 days.
-- All trades must settle and clear within three trading days
from trade date.
-- Use of whip calls, kiting, electronic counterfeiting and other
such manipulations be subject to racketeering laws.
-- Shares may only be shorted on a zero or zero plus tick, except
for registered market makers and recognized arbitrage traders
for their own accounts only and not for client accounts.
-- DTCC must maintain the "identity type" of accounts for shares
transferred to its custody. Shares held in Cash, Excess
Margin, ERISA and similar accounts not be lent under any
circumstance. Already an existing rule, it is being ignored.
-- Real penalties be imposed including interest charges and
sanctions for any trades left unsettled after 3 days. A 10-day
fail be immediately treated as a broken trade.
-- Broker-dealers, clearing firms and clients shown to be engaged
in attempts to circumvent the above guidelines be formally
sanctioned once, and lose their licenses for a second offense.

developing public companies are daily victims. We have been relentless in our
pursuit of the naked short sellers. A jury of American citizens has awarded USXP
punitive damages as a result of naked short sellers manipulating our stock, yet
it continues for us and for many others. I have publicly called upon our
shareholders to contact their Congressional representatives asking for the end
to illegal naked short selling. I have written members of Congress and am
personally meeting with them this week. I am most willing to work with my fellow
Chief Executive Officers of developing and established companies to assist the
SEC in their deliberations. I am here today pursuing this agenda and very
hopeful the new leadership will consider regulatory reform," stated Mr.

der sieht es sicher gern, dass der zukünftige Chef seiner
Charterairline sich so für Sicherheit, Steuereinsparungen und

Der Kurs in Amiland pendelt seit 18.00 Uhr(MEZ) in ganz engen Grenzen zwischen 0,104$ und 0,106$ hin und her.
Sieht aus wie eine flatline die auf einen Ausbruch wartet.

Das Sicherheitsproblem bei Amerikanischen airlines scheint aber immer mehr an Bedeutung zu gewinnen, wie folgende CNBC Meldung zeigt:
Capital Report CNBC – (D) Ed Markey Unscreened Cargo
Rep. Ed Markey, D-Mass and member of the Homeland Security Committee, spoke as to concerns of the 20-year-old college junior from Maryland who took box cutters and other prohibited material on board Southwest Airlines airplanes. Mr Markey also talked about the security problems with unchecked and unscreened baggage traveling upon the same transports as the passengers.
CNBC added “Not only did he skirt security surveillance at Baltimore-Washington International Airport and the Raleigh-Durham airport, but also he managed to hide his contraband on aircrafts where it wasn’t discovered for a month. And his efforts to alert the Transportation Safety Administration to his crime were ignored for weeks. To be sure, carrying box cutters onto an airplane isn't a good thing to do. Nonetheless, Democrats have jumped on the case, saying Heatwole should be celebrated for exposing gaping holes in the nation’s air-security system.”
Mr. Markey reiterated the impotence and urgency of implementing and recommending a system in which unscreened baggage that threatens the security of air travel. In a recent press release, Mr. Markey speaks about this gaping loophole that continues to exist in our passenger plane system.
Mr. Markey also stated in his PR that that “It is widely expected that the TSA will receive recommendations to enhance the fatally-flawed known shipper program (it should be called an unknown cargo problem); increase the number of cargo packages loaded onto passenger planes; reduce the number of days required to make unknown shipper into known shippers; and even allow shippers to ship cargo on passenger planes.
Mr. Markey even mentions Pan Am flight 103 – And that screening and remedying the cargo problem would only cost a fraction of the $87 billion dollars Bush recently signed to ensure Homeland Security.

1) Da haben wir eine Firma die mal gerade ihren umsatz um 550% steigert
2) Der CEO hat vor eine Fluggesellschaft zu übernehmen das einen Umsatz von 160 MIO bedeuten könnte. Wenn ich richtig rechne wäre das wieder ein Umsatzplus von etwa 7000 %!
3) Die Firma hat Gerichtsurteile mit Schadensersatz von 550 MIO Dollar zugesprochen bekommen (aber noch kein Geld bekommen)
4) Der CEO kündigt für Oktober wichtige NEWS an die entscheidend für die Firma sind und strebt ein Listing an der Nasdaq an, soviel ich weiß muss dafür der Kurs aber mindestens eine 1 vor dem Komma haben..
5) Der CEO latscht mal gerade ins Capitol und hat Vorschläge wie man die Sicherheit im Flugverkehr (Paketpost) wesentlich steigern und gleichzeitig Steuern sparen kann.
Jeder normale Mensch kann natürlich einfach so ins Capitol gehen und was vorschlagen.....hä??
6) Zufällig kündigt Bush an, das die Sicherheit erheblich erhöht werden muß und zufällig hat Bush mit der og. Fluggesellschaft einen Wahlkampf bestritten,Zufälle gibts...
7) Der CEO setzt sich heut mal eben zu ner Sitzung der SEC bezüglich naked short selling, in der grundlegende Änderungen im Regelwerk angestrebt werden

Kein Wunder, dass das den CEO so aufregt und er am liebsten an der NYSE
gelistet wär.
Dafür muß er aber halt auch was tun.
Hoffentlich wird dem NAKED-SHORT-SELLING heut ein Ende bereitet.
