TPL Clarifies Stipulation to Dismiss Six Toshiba ASIC Devices From Moore Microprocessor Patent(TM) Infringement Suit to Sharpen Focus on Expansive Category of Infringing System Products
CUPERTINO, Calif.--(BUSINESS WIRE)--
In light of the sweeping scope of infringement of the Moore Microprocessor Patent(TM) (MMP) Portfolio by Toshiba system products, The TPL Group and Toshiba stipulated to sharpen the focus of the Texas infringement trial by eliminating certain Toshiba ASIC devices, which were thought to add little to the ultimate infringement findings other than complexity and possible confusion.
According to Dan Leckrone, Chairman of The TPL Group, "The April 17th stipulation to dismiss the Toshiba ASICs was purely procedural and should not be construed as having any substantive significance. This was simply an effort to streamline the infringement trial scheduled for November by sharpening the focus on the expansive category of infringing system products manufactured and sold by Toshiba and the other defendants."
The TPL Group has a 20-year history of investing its resources to commercialize home-grown Intellectual Property (IP) assets in the form of both proprietary technology and proprietary products based on that technology. "Unlike so-called patent trolls, TPL develops IP assets that are used to develop products that are taken to market together with valuable technology that is licensed to global system manufacturers to generate revenue that funds TPL's next round of innovation," added Leckrone. He cited IntellaSys, a TPL Group enterprise that has developed and is currently marketing distributed digital media semiconductor solutions via three major product brands: SEAforth(TM) multicore processors, Indigita(R) content secure connectivity devices and OnSpec(TM) secure storage controllers.
Texas Court Markman Ruling
Commenting on the recent Markman ruling (www.tplgroup.net/ruling) filed by the US District Court in the Eastern District of Texas, Leckrone stated, "This ruling reflects well the skill of the Texas Court in dissecting and dealing with a very complex case over the past 15 months." He noted that while the ruling overwhelmingly confirms MMP Portfolio claims against Matsushita, Panasonic, JVC, Toshiba, and NEC entities, there remains a specific, highly-technical phrase that will require further scrutiny. The court's decision clearly demonstrates why 19 prestigious global companies have already purchased MMP Licenses."
The extensive scope of products that use MMP technology continues to encourage system manufacturers from around the globe to become MMP Licensees. Since January 2006, HP, Casio, Fujitsu, Sony, Nikon, Seiko Epson, Pentax, Olympus, Kenwood, Agilent, Lexmark, Schneider Electric, NEC Corporation, Funai Electric, SanDisk Sharp Corporation and Nokia have all purchased MMP Portfolio Licenses. The two earliest MMP Licensees were marquee chip makers Intel and AMD. By design, the MMP Licensing Program rewards early movers in specific industry segments by subjecting dilatory, slow-moving licensees in those same segments to progressively higher royalty rates.
About the MMP Portfolio
The Moore Microprocessor Patent Portfolio contains intellectual property that is jointly owned by the privately-held TPL Group and publicly-held Patriot Scientific Corporation (OTCBB:PTSC). The portfolio includes seven U.S. patents as well as their European and Japanese counterparts. It is becoming widely recognized that the jointly-owned patents protect fundamental technology used in designing microprocessors, microcontrollers, digital signal processors (DSPs), embedded processors and system-on-chip (SoC) devices. The MMP Portfolio is exclusively managed by Alliacense, a TPL Group Enterprise.
About The TPL Group
Founded in 1988, Technology Properties Limited (The TPL Group) has emerged as a global coalition of high technology enterprises involved in the development, management and commercialization of Intellectual Property (IP) assets as well as the design, manufacture and sales of proprietary products based on these same IP assets. Among the advanced products that The TPL Group enterprises continue to bring to market are system-on-chip solutions for distributed digital media processing applications.

Patriot Scientific "speculative buy"
Tuesday, July 10, 2007 7:01:22 AM ET
JM Dutton & Associates
NEW YORK, July 10 (newratings.com) - Analyst Richard W West of JM Dutton reiterates his "speculative buy" rating on Patriot Scientific Corp (ticker: PTSC). The 12-month target price is set to $0.75.
In a research note dated July 8 and published yesterday, the analyst mentions that the company has recently declared that a major European information technology company, Groupe Bull, has bought a Moore Microprocessor Patent™ Portfolio license from the TPL Group. The re-examination of the Non-Final Action for the US Patent '584 by the US patent and Trademark Office (USPTO) is proceeding, the analyst says.

Patriot Scientific and Holocom Networks Announce Secure Computing Company Funding
2007-07-20 09:15 ET - News Release
CARLSBAD, Calif., July 20 /PRNewswire-FirstCall/ -- Patriot Scientific Corporation announced today that Pilot Power Group, Inc. and its affiliate EDMS, LLC have acquired a controlling interest in DataSecurus, LLC (formerly Holocom Multi-Domain Computers, LLC). DataSecurus develops secure data- and power-control technologies that enable high-security PCs for government and military installations.
Users of DataSecurus PCs can access both secure classified networks and unsecured unclassified networks (such as the Internet) from the same computer, without the possibility of unauthorized access or loss of classified data. Previously, such users required two or more physically separate PCs on the same desk. The patented technology, known as the Sentinel(TM) System, has been praised by the U.S. Department of Defense personnel, NATO officers, and other federal agency employees.
Patriot Scientific CEO Jim Turley said, "We saw the potential of the technology but also realized that it's not among our core competencies. DataSecurus needed added capital and industry expertise, so Patriot felt that it was wise to attract a partner willing to make that investment. Pilot Power Group will share ownership in the enterprise while carrying the product through to commercialization. This configuration made the most sense for our shareholders."
Patriot's subsidiary, Holocom Networks, will retain a 22% interest in DataSecurus, as well as ongoing board-level positions. Holocom also has the option to invest additional capital in DataSecurus to either maintain or increase its ownership position. Holocom Networks is jointly owned by Patriot and Scripps Ventures, Inc.
Thomas R. Darton, vice president of Pilot Power Group and CEO of DataSecurus said, "We are very excited about this new investment and feel that the technology has great promise. We have completed a supply contract for design services, have signed consulting agreements with key stakeholders in the technology, and have signed an exclusive manufacture, distribution and sales agreement with the developers and owners of the technology. We will have a number of announcements to make as this product comes to market later this year. The company is accepting orders for shipment in the fourth quarter of 2007." He added that "Patriot's history of involvement in high-technology products and design will make their representatives valuable Board members for DataSecurus."
