1.
OTCTrader...By looking at the judge's past history on motions for delaying the Markman, it is plausible, that one could assume he would do the same in this instance.....BUT...as your post shows we have a difference here...the defendant in the case you mentioned waited till AFTER...the Markman to file for a stay...
"He concluded that the first factor, which asks whether a stay would unduly prejudice or present a tactical disadvantage to the plaintiff weighed against a stay, since the defendant had waited until the case was a year old and the court had held the Markman hearing before moving for a stay despite the fact that over 90% of all reexamination requests are granted (citing statistics from the United States Patent and Trademark Office, Ex Parte Reexamination Filing Data dated September 30, 2004). "
In our case, the Markman is still untried and this prior case would not be a precdent for the judge to rule in our favor against a motion to stay our Markman..
In fact the last Markman I was involved with was stayed for 2 years till the ex parte re-exam was completed.
Granted, that in my previous case, we were not in the same district that seems to favor patent holders. I can see though, the case being argued by the defendants that a stay would be logical due to the granting of a reexam by the PTO since the Markman is scheduled but not started as of this date.
I look for a stay to be filed ASAP this morning... sorry but just MHO.

Sharp becomes the 16th major system manufacturer to purchase an MMP Portfolio license from The TPL Group since January 2006.
“The far-reaching applications of MMP design techniques continue to motivate global electronics companies to become MMP licensees,” said Mike Davis, Alliacense Sr. VP of Licensing. “Significantly, all MMP licensees to date enjoy worldwide brand recognition with several ranking among the Fortune 500.” He confirmed that the formative MMP Portfolio Licensing Program is designed to reward early movers in specific industry segments by subjecting subsequent licensees in those same segments to progressively higher royalty rates.

CARLSBAD, Calif., April 11 /PRNewswire-FirstCall/ -- Patriot Scientific
Corporation (OTC Bulletin Board: PTSC) confirmed today that Sharp
Corporation has purchased a Moore Microprocessor Patent(TM) (MMP) Portfolio
license. Patriot Scientific and The TPL Group are co-owners of the MMP
Portfolio, which Alliacense, a TPL Group enterprise, exclusively manages.
Sharp is the 16th company to join the distinguished roster of global
manufacturers that have captured early-mover MMP licensing berths in
specific industry segments since January 2006. Alliacense again confirmed
that subsequent licensees in segments where early tiers have been secured
are subject to progressively higher royalty rates on relevant products.
The intellectual property assets protected by the MMP Portfolio
encompass fundamental design techniques that enable higher performance and
lower cost digital electronic systems ranging from cell phones and portable
music players to communications infrastructure and medical equipment as
well as automobiles, which today utilize dozens of microprocessors.
"As a co-owner of the MMP Portfolio we are pleased to welcome Sharp to
the growing family of companies participating in the MMP Portfolio
Licensing Program," said David Pohl, chairman and CEO of Patriot Scientific

Pentax, Olympus, Kenwood, Agilent, Lexmark, Schneider Electric, NEC

the decision by Patriot's board of directors in June 2005 to shift the
company's primary business model from manufacturing and marketing products
to a model currently focused primarily but not exclusively on licensing
their joint venture MMP patent portfolio. He emphasized that Patriot
Scientific invested millions of dollars and hundreds of thousands of
man-hours over 12 years or more developing and bringing to market products
based upon the company's intellectual property, including IP contained in
the MMP Portfolio.
"We will continue to seek and evaluate opportunities to diversify our
revenue stream by developing and marketing new technologies, entering into
joint ventures or by acquiring other companies and technologies," Pohl
stated, "always pointed toward the goal of increasing the financial
position and strength of the company and providing value to our
shareholders."

A United Business Media company.
gute Hinweise geben.
P.S.
Joker, Kreisch - muss man bald gratulieren ?

cu
es wohl kaum. Bin mal gespannt was heute passiert.
Abenteurer
