There are soon to be at least $8-billion — maybe more — sitting in  the naked remains of Nortel, but nobody has a clue to how that money  could be or should be allocated — or even whether it will ever be  allocated, given the Dickensian paralysis that has engulfed the Nortel  bankruptcy proceeding over the past two years.

The $8-billion figure includes the blockbuster $4.5-billion windfall  from last week’s auction of Nortel’s patents to Apple and a consortium  of telecom companies. Add the patent cash to the more than $3-billion  already on hand — apparently held in escrow at Goldman Sachs in New York  — and suddenly there’s a greater incentive for all of Nortel’s  claimants to reach agreement on who gets the money. If there’s more to  get, the urge to compromise might be stronger.

(Reuters) - Canadian Industry Minister Christian Paradis said on Thursday that officials in his office are studying whether to formally review a sale of Nortel patents to ensure investment law was properly applied.

 

A consortium including Apple (AAPL.O), Microsoft (MSFT.O) and Research In Motion (RIM.TO) bid $4.5 billion to buy the thousands of Nortel (NRTLQ.PK) patents in a recent auction. [ID:nNL3E7I10H]

 

Under the Investment Canada Act, the federal government must review any foreign investment or purchase of Canadian assets worth C$312 million ($325 million) or more. It can reject transactions that do not provide a "net benefit" to Canada.

 

But while the Nortel patents' sale price clearly exceeded that threshold, their book value is likely far lower and may make a review difficult to justify.

 

Asked by reporters on a conference call if he had any specific concerns about the investment, Paradis said: "No, the point is just to make sure ... that we are compliant with the law."

 

Paradis declined to provide a timeline on when the ministry would decide if it will review the purchase, citing legal restrictions. He also did not say if the consortium members had sought approval.

Freitag ist und Nortel am Montag etwas offizielles zur Auktion sagen wird. Ich glaube schon, dass die Amis sich nachher eindecken werden.

 

was passiert wenn das Gericht die Auktion nicht absegnet ?  

Da die Burger bisher noch nicht wirklich gezockt haben, gehe ich davon aus, dass da noch was passiert. Auch drüben herrscht überwiegend unsicherheit über den Ausgang der Geschichte. Ausschlaggebend ist für mich Montag der 11.07.2011. Bleibt also vielleicht nicht mehr viel Zeit für einen günstigen Einstieg. Ich könnte mir sogar vorstellen, das die Burger erst ab 20.00 richtig Gas geben, denn heute würde es sich ja Lohnen (mit Sicht auf Montag). Es wäre toll, wenn es bereits heute Nachmittag anzieht.  

 

das ist glaub ich schwer zu sagen, aber ich empfinde es nicht als schlechte news, denn entweder wird die auktion neu ausgetragen - was wieder neue spekulationen mit sich bringen würde und somit neue chancen - oder wenn der staat meint, dass die patente zu wertvoll sind, um an irgendeine firma abgetreten zu werden, dann müsste doch der staat das irgendwie "übernehmen", sprich für nortel in irgendeiner form "einspringen" .....

sind nur gedankengänge - wenn wer mit dem rechtssystem drüben vertraut ist, kann der sicher mehr dazu sagen... also, ich wäre dankbar für jeden input!

Nortel Debt Rises to Record Amid Speculation of Full Recovery   July 7 (Bloomberg) -- Nortel Networks Corp. bonds rose to a record amid speculation holders of the bankrupt company’s debt may recover all their principal and back interest following a sale of the telecommunications-equipment maker’s patents.   Nortel’s $450 million of 10.75 percent bonds that mature in July 2016 rose 1.9 cents to 108.9 cents on the dollar, according to Trace, the bond-price reporting system of the Financial Industry Regulatory Authority. That’s the highest close since the Mississauga, Ontario-based-based company sold the debt in January 2008.   Speculation that the proceeds from the $4.5 billion patent sale could entitle debt holders to both their principal and any interest accrued since Nortel filed for bankruptcy reorganization in January 2009, may be lifting the bonds, said Andrew Gottesman, a New York-based vice president with SecondMarket Inc., a private exchange of illiquid assets such as bankruptcy debt.   “It may mean they’re expecting something in a bankruptcy case that is atypical,” Gottesman said today in a telephone interview. “You only get post-petition interest when there is money for everybody.”   The bonds climbed July 1 after Cupertino, California-based Apple Inc. and other technology industry rivals outbid Google Inc., exceeding investor estimates for the more than 6,000 patents and applications related to wireless and Internet technology.
