... die von mir im Beitrag "Dockets #47318, #47319 still not accessible" als noch nicht zugreifbar festgestellt werden mussten, sind jetzt endlich aufrufbar...

Es war in Sachen derer beiden Dockets bezüglich derer ihnen zu hinterlegenen Documente schon im November um Gerichts-relevante Meinungs-Äußerungen gebeten worden, welche ihrer Passagen jeweils "redacted", also geschwärzt werden sollten - und welche halt nicht.

Derartige Schwärzungs-Abfragen verzögern die Veröffentlichung derer ihnen unterworfenen Schriftstücke oft ganz erheblich. Ich werde die beiden jetzt endlich zugreifbaren Dockets hier natürlich umgehend verlinken...

... vom 12. November 2014, die Mitte December 2014 (siehe oben) endlich zugreifbar wurden, geben die ihnen hinterlegten Documente ja Ansage-gemäß erst nach dem 10. Februar 2015 für die Öffentlichkeit frei: "Transcript Access will be restricted through FEB/10/2015"...

Dennoch sind wir bezüglich des Innhalts derer ihnen hinterlegten Documente auch jetzt schon nicht mehr gänzlich auf Rätsel-Raten angewiesen, da die beiden Dockets #47318 und #47319 ja ausdrücklich angeben, dass sie sich auf die früheren Dockets #15363 und #19888 und #46364 beziehen, und deren hinterlegte Documente sind ja längst schon bekannt!

Alles sehr förmlich mit der Washington State Tobacco Settlement Authority...  

... belegt in diesem Chapter-11-Verfahren auch jetzt noch die absolute Mehrheit aller Docket-Numbers, wodurch man höllisch aufpassen muss, dass man unter der ganzen Flut von seitenweise nur mit Claim(s)-Transfers belegten Docket-Numbers nicht irgend etwas Anderes glatt übersieht!

Haupt-Käufer derer Forderungen gegen Lehman sind nach wie vor die großen Banken, wobei festgestellt werden kann, dass das Haus Goldman, Sachs & Co. die regen Ankaufs-Activitäten derer anderen Banken sogar noch übertrifft. - Doch in der Presse liest man davon nichts...

Man kann also auch bei jenen Docket-Numbers, die für den Forderungs-Handel "verbraucht" sind, die ihnen hinterlegten Documente in der selben Weise zugreifen, wie man das von denen mit anderen Subjects belegten Docket-Numbers gewohnt ist. - Wieso ich hier darauf hingewiesen habe, erkläre ich später...

Activitäten des Forderungs-Handels erkennt man in der Flut derer Dockets
am Passus "Transfer Agreement FRBP", unter welchem Akronym jeweils die "Federal Rules of Bankruptcy Procedure" zu verstehen sind...

Und was es mit der immer wieder vorkommenden Formulierung "Transfer Agreement 3001 (e) 2" auf sich hat, kann unter der "Rule 3001. Proof of Claim" wie folgt nachgelesen werden:

(e) Transferred Claim.

(1) Transfer of Claim Other Than for Security before Proof Filed. If a claim has been transferred other than for security before proof of the claim has been filed, the proof of claim may be filed only by the transferee or an indenture trustee.

(2) Transfer of Claim Other than for Security after Proof Filed. If a claim other than one based on a publicly traded note, bond, or debenture has been transferred other than for security after the proof of claim has been filed, evidence of the transfer shall be filed by the transferee. The clerk shall immediately notify the alleged transferor by mail of the filing of the evidence of transfer and that objection thereto, if any, must be filed within 21 days of the mailing of the notice or within any additional time allowed by the court. If the alleged transferor files a timely objection and the court finds, after notice and a hearing, that the claim has been transferred other than for security, it shall enter an order substituting the transferee for the transferor. If a timely objection is not filed by the alleged transferor, the transferee shall be substituted for the transferor.
