Mit der finanziellen Auswertung der  im vorigen Posting angeführten Patente hat Local Corp gerade erst begonnen, und zwar bei dem ältesten vorhandenen Patent. Und es gab gleich beim ersten Verwertungsversuch von einem von sehr vielen Kunden, die dieses Patent benutzen, eine Einmalzahlung von 700.000 Dollar. In der Bilanz sind diese Patente übrigens nicht aktiviert.

Local Corporation is continuing its efforts to enforce its intellectual property rights.

Dass es tatsächlich 700.000 Dollar waren, wurde zunächst nicht veröffenlticht, aber das kam dann durch das Q10-Filing an die SEC doch ans Licht, wo auf der Seite 24 folgendes steht:

"Income from settlement and patent licensing
During the third quarter of fiscal 2014, we reached a settlement agreement in the patent infringement action against Fry’s Electronics, Inc. As part of the settlement agreement, we received a one-time patent license fee payment of $700,000 related to prior infringement of our patent."

Dass da aber noch sehr viel mehr drin ist,  zeigt diese Aussage des CEO, als das Patentabkommen von Local Corp veröffentlicht wurde:

“We are very pleased with the outcome of this settlement, and we believe this further validates the significant unlocked value of our robust patent portfolio,” said Fred Thiel, Local Corporation chairman and chief executive officer. “We have identified hundreds of websites and applications that we believe infringe upon this patent and believe there are likely thousands more. Not part of the valuation through H.C. Wainwright from September 4, 2014 are the news about the monetization of the Patent No. 7,062,453.

Local Corp had only started the monetizaton of patents with the following oldest patent of it’s 13 patents. No patents is capitalized in the balance sheet today, but only the following patent alone could have a value of 100 million..

At the date of the publishing of the license an amount was not published, but now through the filing of 10 Q you can recognize the amount:

But it will come a lot better, if you look at the following sentences of the CEO by the publishing of the license:

Not complete continue for the following argumentation: “….and new strategic initiatives that should boost organic traffic and revenues and allow for stronger margins.” The fight against fraud decreased the network-traffic and revenues with its high margins. But invest in the quality of traffic will increase the revenues in the future:

deutschen Local Search-Unternehmen My hammer noch nicht gemeldet hat, muss ich die Daten von My Hammer vorstelen, die aus dem letzten veröffentlichten Bericht stammen, die Ihr dort auf der Webseite dieses Unternehmens einsehen könnt.

Umsatzerlöse = 4,6 Millionen

Netriebsergebnis = minus 1,1 Millionen

Marktapitalisierung = 6,68 Millionen

Daraus ergibt sich ein Umsatzmultiple von 1,45 für My Hammer, das durchaus angemessen sein kann, aber das Umsatzmultiple der meines 'Erachtens sehr viel besseren Untenehmung Local Corp beträgt nur 0,35.

Dass das keine Uraltanzeigen sind, könnt Ihr an den +-Tagen hinter den Anzeigen erkennen und ganz unten angezeigt ist auch, dass Glassdoor heute abgedatet hat: "Updated Nov 16, 2014"

All das ist das Resultat der Umstrukturierung von einem in der Spitze zu ca. 75% aus Vertriebsleuten bestehenden Unternehmen zu einem überwiegend Technologieunternehmen.

waren meines Erachtens die Bash-Operationen der wohl meist nackten Shortseller letzte Woche, denn die durch ihre Operationen erhoffte Verkaufswelle bieb aus: Tortz der heftigen Kursschwankungen gingen am Donnnerstag und Freitag zusammen nur etwas mehr als 2% der ausstehenden Aktien über den Ladentisch - und davon dürfte weitaus mehr als die Hälfte noch Wash-Trading gewesen sein.

Meines Erachtens wird schon die Diskussion um die angelaufene Patentverwertung beim ersten Patent aus der folgenden Liste der 13 Patente - und das nur bei der ersten Lizenzierung von hunderten oder tausenden bei diesem einen Patent - den Shortsellern den Garaus machen. Die Wahrscheinlichkeit, dass der Shortsquezze schon näcste Woche startet, ist also sehr groß. Denn die eine Zeile im Q10-Filing über mehr als 30 Zeieln, die über 700.000 Dollar einmaliger Lizenzzahlung von Fry's berichtet kann man leicht überlesen, wie es mir (siehe weiter oben) bei einem anderer Aspekt auch passiert ist.

Das mit dem Überlesen der ersten Patentzahlung in Höhe von 700.000 Dollar durch Fry's gewinnt sogar noch dadruch dramtisch an Bedeutung, weil diese Meldung in der Kurzfassung, die man üblicherweise im Internet auf Aktienboard findet, gar nicht auftaucht.

des ersten Lizenznehmers Fry sind sicher auch eine andere Hausnummer als die von Dir angeführte My Hammer.

An die ganz großen Unternehmen hat sich Local Corp noch nicht gewagt, denn dann wäre die Prozesssumme größer ausgefallen und im Falle einer Prozessniederlage, die glücklicherweise nicht eingetreten ist, auch die Kosten. Wie mit Fry's wird man hier auch versuchen, sich gütlich zu einigen, denn die Verhandlungsparnter sind fast immerauch Geschäftspartner in anderen Bereichen (z.B. beim Datensammeln durch Krillion, wo auch die Läden von Fry's autauchen).

Ganz schwierig wrd es mit der Monetarisierung dort, wo man Google und Yahoo verklagen müsste, ohne die Local Corp zumindest momentan kaum auskommen würde. Dieses Verbandeltsein und das Prozesskostenrisiko hat ja auch dazu gefäührt, dass Local Corp nur sehr langsam und vorsichtig vorgegangen ist. Ganz anders würde es dagegen aussehen, wenn ein großes finanzkräftiges Unternehmen Local Corp übernehmen würde, denn die könnten eher ihre Rechte durchsetzen. Daher halte ich es auch für wahrscheinlich, dass man zumndest das Paket der fünf Pay-Per-Call-Patente verkaufen wird und sich selber Lizenzen davon behalten wird. Denn Local Corp hat als Quasi-Erfinder des Online-Local-Search hier auf einigen Sektoren Grundpatente, an denen kaum jemand vorbei kommt und die momentan schon massenhaft verletzt werden - aber wie der Fall Fry's zeigt, gibt es ja auch Geld im nachhinein für schon stattgefundene Patentverletzungen.

"The advertising industry is going through something akin to the automation of the financial markets in the 1980s. This has helped to make advertising much more precise and personalised. Some advertising agencies and media companies have told their executives to read “Flash Boys” by Michael Lewis, a book about Wall Street’s high-speed traders, to make quite sure they get the message.

Real-time bidding sounds high-tech but straightforward. When a consumer visits a website, his browser communicates with an ad server. The server sends a message to an exchange to provide data about that user, such as his IP address, his location and the website he is visiting. Potential ad buyers send their bids to the exchange. The highest one wins and an ad is served when the website loads. All this typically takes about 150 milliseconds."

GPS-Ortung, Websockets, Wi-Fi networks machen Krillion zu einer Übergangstechnologie und damit zunehmend wertloser.
Havvit wäre eine gute Chance gewesen aus Krillion einen Vorteil zu ziehen, doch sie ist kein Hit. Die Großen - wie priceline, google, etc - werden die moderne Technologie nutzen aber erfolgversprechendere Wege als Havvit gehen.
