SAN FRANCISCO, Nov 3 (Reuters) - Marijuana private equity investor Privateer Holdings has raised $40 million in convertible debt ahead of next week's elections, with pot legalization on the ballot in nine U.S. states.
Several investors rushed to place their funds, while others held back to wait for the election results.
Of the nine states that will vote on Tuesday on legalizing medical or recreational marijuana, California ranks as the most important. The most populous U.S. state is considering allowing recreational adult use. If the measure passes, it is expected to legitimize part of a multi-billion-dollar black market and open new opportunities for companies ranging from software to pot delivery.
Financial services firm Cowen and Co forecasts a $50 billion U.S. market in a decade, up from $6 billion in legal sales today. U.S. law prohibits marijuana but federal agencies so far have limited their enforcement effort for companies which follow local laws in states that have legalized pot.
Seattle-based Privateer is one of several funds and investment companies targeting marijuana businesses. It said investors were divided on when to make their moves.
"Most of the potential lead investors wanted to wait until after next Tuesday to invest," Chief Executive Brendan Kennedy said in an interview. Others were ready to invest, but it was difficult to agree on how to value Privateer, with the outcome of the state votes unclear. The presidential race was a secondary issue, he added.
"This is a way to sort of take capital from investors without having to negotiate the price," he said. Privateer hopes to raise $100 million in the next round, including the notes.
The valuation of the company will be set when the round closes, and convertible note holders will get a 15 percent discount when they get equity in Privateer, he said.
The company plans to put more than half of the round in companies outside the United States, including Canada and potentially Australia, he said.

Report: Marijuana sales to quadruple after election

The marijuana industry could quadruple in size after the 2016 elections, according to a new study released Wednesday.
The Los Angeles-based cannabis firm MedMen projects legal pot sales in the U.S. could increase by $20.5 billion per year after voters in nine states weigh ballot measures that would legalize recreational marijuana.
"The potential of this industry is undeniable," MedMen CEO Adam Bierman said. "The question is how we make sure it is done in a safe, responsible and controlled manner."

The recreational use of marijuana has already been legalized in Colorado, Washington state, Oregon, Alaska, and Washington, D.C., and another 21 states permit medical marijuana.
These states account for about $7 billion in legal marijuana sales each year, according to MedMen.
But that figure is projected to explode to as much as $27.5 billion, depending on how many more states legalize pot on Election Day.
On Tuesday, voters in Arizona, California, Maine, Massachusetts and Nevada will decide whether to legalize recreational marijuana for adults.
Meanwhile, medical marijuana will be on the ballot in Arkansas, Florida, Montana and North Dakota.
MedMen calculated the market price for marijuana and the rate of use in each of these states. It determined that recreational marijuana could contribute as much as $8.3 billion in sales to California’s economy, followed by $6.85 billion in sales in Nevada.
Florida alone has the potential for $2 billion in medical marijuana sales, according to the study.
Arizona and Massachusetts could each generate $1.45 billion in recreational marijuana sales. In Maine, legal weed dealers have the potential to sell $287 million per year.
While North Dakota could see $75 million in medical marijuana sales.

Thanks. I contacted the author of the article that was linked several times yesterday. The thrust of his article was that VAPE could go to $1.00. Anyway, I asked which pot stocks he thought were legit companies. His short list was....

Vape Holdings (OTCPK:VAPE) is on fire. While the company itself has it's own fair share of struggles for legitimacy, VAPE stock continues to climb at a staggering rate. As I have said before, unlike other fraudulent share selling scams traded in the OTC Pot Stock sector, I have actually used Vape Holding's products. So far as I can tell, Vape Holdings is trying to establish itself as a legitimate cannabis entity. Having at one time commanded a market cap of $400m+, is it possible for this small penny stock to once again reach the lofty dollar per share mark?
During the Pot Stock Bubble of 2014, VAPE was worth over 40 per share. Keep in mind the company had just come off a reverse split, reducing the share count to a miniscule 10m outstanding shares. With 10m shares at 40pps, the peak of VAPE's 2014 marketcap reached $400m and some change.
As you read this, keep in mind my wacky, unproven theory about a "$500m ceiling" to the exuberance of these OTC Pot Stocks:

Applying that kooky concept to the 2014 highs and VAPE's current fundamentals, VAPE's stock would be worth approximately 1.20 or so.
This seems crazy, but weirder things have happened. Remember the DotCom Bubble? During that time certain companies were given marketcap valuations higher than their entire respective industry. For example, Pets.com was valued around $25b whereas the entire pet product industry was barely worth $20b. In fact, Pets.com was worth more than PetCo, PetSmart and all other pet companies COMBINED. A similar valuation occurred with eToys.com, a company valued more than the combined total of most of the large toy retails of the day. If the same sort of irrational exuberance was applied to VAPE that was applied to Pets.com or eToys.com, VAPE's pps could be in multiple dollars.
However, before we start planning exotic car purchases and beachfront retirement property, it would be nice to see VAPE crack into the .10 range. Today's volume speaks volumes as VAPE traded its daily average in the first hour of the trading day. This is reminiscent of 2014 and not of the small, unsustainable pops over the past few years. As of the time of this writing VAPE has traded over $1.5m in daily volume, which for a penny stock is quite remarkable especially considering this rally is already about 2 weeks deep.
There is a lot of money being committed to VAPE. In a sector rife with fraud and deceit, VAPE seems to be a potentially viable company selling a legitimate product. I have no fear in plunking down some capital at these levels.

Ich meine wenn die Wahl am Dienstag "richtig" ausgeht - wird er MJ-Sektor von Geld nur so
geflutet..und Vape....ja vielleicht VAPE....wird die Überraschung des Sektors, und
wir stehen schneller da, wo wir jetzt noch nicht dran zu glauben wagen. :-)
Neuer Markt - Riesen Euphorie etc.
Firmen wie CMGI - wer sich noch erinnern kann - wurde gesplittet, gesplittet, gesplittet, und
trotzdem stieg der Kurs ohne Unterbrechnung.
Glaub es waren damals - um die 20.000 % was der Kurs innerhalb von 1 Jahr gemacht hatte.
VAPE ??? Mal sehen.
In der ganzen Euphorie aber dann ganz wichtig, rechtzeitig auch bissl Geld abziehen, und
CASH-Aufbauen.....für den Fall, das nach einigen Wochen / Monaten eine heftige Korrektur kommt.
Und die wird auch im MJ-Sektor - irgendwann - wenn wir viel zu hoch gelaufen sind - kommen !!!!
Aber da haben wir ja noch Zeit - denke wir sind auf einer Skalla von 1-10 - derzeit bei erst
bei ca. 2 auf der "Boom-Faktor-Überhitzungszone" !!

Bin nur am einsammeln...
in 3 Tagen die US-Wahl für die Proh.64 MJ positiv ausfällt.
Ich glaube aber das den Run dann locker bis ins Jahr 2017 anhält - und wir
vielleicht sogar Richtung 2 - 2,50 Dollar je Vape-Aktie laufen könnten.......
Bin schon SEEEHHRRR gespannt was ab Dienstag / Mittwoch nächste Woche passiert.... :-)
Wenn ja, wäre nächste Woche - bei guten Zahlen - der perfekte Zeitpunkt.
