EuroGas Arbitration Ready to Begin, ICSID Tribunal Now Complete
Bratislava, November 24 (TASR) - Arbitration proceedings between the Slovak Republic and companies EuroGas Inc. and Belmont Resources Inc. can now be launched at the International Centre for the Settlement of Industrial Disputes (ICSID) in Washington, with the tribunal set to deal with the case now complete, according to information obtained by TASR.
Neither of the parties involved in the dispute - EuroGas and the Slovak Finance Ministry, which is representing Slovakia - was willing to provide any details at this time. "The Finance Ministry will proceed in accordance with respective regulations for conducting this dispute and with the provisions of respective international agreements," said the ministry's press department in a statement.
As the petitioner in the arbitration, EuroGas is demanding from the state of Slovakia compensation of $3.2 billion (€2.3 billion) for what it calls a marred investment in Gemerska Poloma (Kosice region) concerning the loss of a talc quarry in 2004.
EuroGas board of directors chair Wolfgang Rauball stated in this respect that the firm has suffered damages due to P.O. Box companies based in Liechtenstein and Cyprus along with suspicions of industrial espionage involved in a lawsuit concerning the protection of rights from unfair competition that has been going on since 2008 in Kosice.
The lawsuit in question concerns Rozmin, a subsidiary of EuroGas, and a firm called VSK Mining (currently called Eurotalc). It revolves around the misappropriation of sensitive documents that constituted business secrets. The documents concerned preparations for exploratory drilling and a feasibility study, said Rauball.
"These documents were misappropriated by former Rozmin associate Peter Corej. Based on them, an accounting firm owned by his wife, Economy Agency RV, acquired a licence for talc mining. Later he used the documents to draft a doctoral thesis at Kosice Technical University, and he's also applied for patent protection," Rauball told TASR.
Corej's patent request has been subject to assessment on the part of the Slovak Industrial Ownership Authority. According to documents acquired by TASR, there are several objections against the request that call for the application to be rejected. A company called JSP Logistics, for example, objected based on the claim that the method described in the application has actually been in use for 200 years. A similar argument was raised in another objection by Eurotalc, which is involved in a dispute with a EuroGas subsidiary. In addition, the company stated that even if it were a new method, Corej has no right to use it. "This invention would be created while meeting tasks emerging from a former employment contract. This right has been transferred to the employer, as the contracted parties involved didn't agree otherwise," stated Eurotalc.
Rauball claims that objections from three independent Slovak companies confirm his suspicions that industrial espionage has been used against EuroGas. "It's apparent that protected technical information has been misused for the personal benefit of a former Rozmin associate. This is also a reason to continue in the case concerning the protection of rights from unfair competition against Eurotalc at Kosice Regional Court," added Rauball, who's also calling for Corej's doctoral thesis to be made accessible as evidence before the court. "We expect this proposal to be plagiarised, not worthy of a scientific patent and that it won't be accepted by the Patent Office," he added.
The Technical University in Kosice (TUKE) stated that it can't make the thesis in question available. "The person concerned doesn't have a licence agreement with TUKE involving a written agreement that would make it possible to make his thesis available. Furthermore, he had submitted a written statement prohibiting any access to his thesis," wrote the university.
Meanwhile, the case has been suspended for an undetermined period of time due to bankruptcy proceedings involving Rozim, TASR was told by Kosice Regional Court spokesperson Marcela Galova. In line with the law on bankruptcy and restructuring the announcement of bankruptcy proceedings interrupts all court and other proceedings that concern the property of the company concerned, she explained.
Rauball expects that the proceedings at the Kosice court will continue soon, after the bankruptcy proceedings concerning Rozmin are concluded. The whole case has involved further accusations. Corej filed a criminal complaint against EuroGas based on which various police units seized almost 16,000 pages of documents, computers and software with sensitive information. The investigation into this case has been suspended for the moment, however.
Slovakia's Supreme Court had ruled twice vis-a-vis the case in the past, claiming that the removal of the excavation licence was illegal. EuroGas then began indicating plans to take legal action over the loss of the talc quarry against Slovakia in 2010. At first, it demanded compensation of €500 million in 2011. One year later a company called EuroGas Inc., registered in the USA, also began claiming compensation. EuroGas asserted that its rights related to a trade agreement between the erstwhile Czechoslovakia and the USA from 1991 had been violated. The Slovak Finance Ministry last year denied that any such agreement had been broken.
The talc deposit in Gemerska Poloma was discovered accidentally during a search for tin in 1985. The talc from the deposit has high levels of purity, with experts viewing it as one of the most important in the world. The largest producer of talc worldwide is China, but significant deposits are also located in the USA, Brazil and India, while Finland is a significant producer in Europe. In view of the wide-ranging options for the industrial use of talc, mainly in the pharmaceutical, chemicals, cosmetics and paper industries, market demand for this raw material is rising steadily...
