Injunction granted – in part – in mining claims dispute Print

LOVELOCK — The judge presiding over Coeur Rochester v Rye Patch Gold granted the injunction sought by Coeur to prevent RPG from entering the mine site.  However, the injunction was granted only in part.

Judge Michael Montero drew a line around the area of operations --  to include the heap leach pad, the open pit, the haul road, the rock crushing area --  and issued the injunction that will prevent RPG from entering that area for reasons of safety.

Otherwise, RPG may work the claims obtained after Coeur Rochester failed to pay $75,000 in federal maintenance fees before August 31, which resulted in the loss of more than 400 lode claims covering more than 8,000 acres.

Montero issued the injunction late Tuesday (Dec. 20) in 6th Judicial District Court after hours of testimony.  SPJ will post a more detailed account of the hearing on Wednesday (Dec. 21).

First in Time, First in Right. This is a win for Rye Patch Gold to carry forward into the 2JDC. Each day that Rye Patch geologists are on the ground working strengthens their case in the Quiet Title action coming in 2012. Hope you cover that trial too, this is the mining story of the year. ... musst halt mal lesen, bevor Du austeilst. Es ist immer wertvoll, die beiden Seiten der Medaille zu kennen. Insofern war die Meldung aus Sicht von Coeur durchaus berechtigt und zudem noch gar nicht gepostet. Daraus lässt sich auch ein Zeitfenster ablesen: offen und vertagt auf 2012. Stattdessen eiert manch einer hier herum, um mit Stackato-Posts zu deuten, warum jetzt der Handel ausgesetzt sei. Und das im ein oder anderen Fall wegen 2 EUR 75 ... Bravo!

Rye Patch Granted Access to the LH Claims

VANCOUVER, BRITISH COLUMBIA -- (Marketwire) -- 12/21/11 -- Rye Patch Gold Corp (TSX VENTURE:RPM)(OTCQX:RPMGF) ("Rye Patch" or the "Company") reports that the state district court in Pershing County, Nevada granted access to Rye Patch Gold on the LH claims outside of a court-defined boundary. To ensure the safety of Coeur Rochester and Rye Patch Gold employees, contractors and consultants, the Sixth Judicial District Court outlined an area encompassing the Rochester mine's current open pit, waste dumps and heap-leach pads and a buffer area around them. The enjoined areas affect only a portion of the lands on which the 402 senior LH unpatented mining claims are located. Rye Patch Gold has access to continue exploration and development work on the remaining LH unpatented mining claims. The District Court will enter a formal written order.

The 402 unpatented mining claims cover 30.3 square kilometres and an unknown portion of the Rochester and Nevada Packard resources along with numerous gold-silver targets which Rye Patch Gold has identified within the newly staked ground. The geologic team is working to assess the amount of gold and silver resource present on the LH claims. According to Coeur d'Alene's disclosure statement, as much as 20% of the Rochester mine's reserves and a significant portion of the resource lie within the LH claims.

Rye Patch's geologic team will be back on the ground sampling, mapping and preparing for a winter drill program. Permits for drilling have been submitted to the BLM for the Packard/Mystic target and the portion of the Northwest Rochester discovery area outside of the injunction boundary. A third drill permit is in the works for the Independence Hill area adjacent to the Company's 100% owned and controlled Lincoln Hill project. Published drill results show the Nevada Packard resource continued from the patented claims northward on to the LH claims. Several additional targets are within the claim block including the Mystic, Independence Hill and Limerick Basin which will be permitted. Finally, the Black fault zone is within the eastern portion of the LH Claims. This ore control has significant potential and controls gold and silver mineralization at the Relief Canyon, Packard, Rochester, and Spring Valley deposits. All these targets are presently being evaluated and prioritized.

The Rochester ore body is open to the north and northwest and the pit boundary is projected by Coeur d'Alene to expand on to Rye Patch Gold's senior LH unpatented mining claims.

The court-ordered injunction remains in place until resolution of Rye Patch Gold's claim that title to the senior LH unpatented mining claims is superior to the junior unpatented mining claims which Coeur Rochester staked over the LH Claims. This injunction order supersedes the Temporary Restraining Order the judge entered on December 5, 2011 against Rye Patch. The underlying legal action in this case will continue and discovery will commence with a trial expected in 2012.

 Da ja i.m. sowieso keiner Aktien von Rye Patch handeln kann, würde ich gerne wissen ob seitens Rye trotzdem nicht verkündet werden darf, warum der Trading halt beantragt worden ist..? Jetzt kann doch eh keiner den Kurs beeinflussen...,

und ich könnte heute Nacht besser schlafen..!

was für ein tag - dacht ich komm nie mehr zuhause an - erstmal vielen dank an alle die sich ja fast schon sorgen um mich gemacht haben - nein ich hab nicht in panik morgens verkauft - ich steh immernoch volle kante unterlippe drinnen.

jetzt erst mal die news gelesen und des von madold macht mir ja quasi schon wieder kleine sorgen - kann den mal jemand bitte entkräften :)

eine übernahme halte ich aktuell noch nicht für möglich - fragt mich nicht wieso aber das käme irgendwie zu "überraschend" einen tag nach richterspruch

Tja so schnell gehts. Die L&S Kurse sind Schätzkurse. L&S muß sich über große Spreads absichern, und verdient dabei, nicht immer, aber bei der Mehrzahl der Trades. So funktioniert ihr außerbörsliches Geschäftsmodell. Würde jetzt einer 100k ordern bei 0,64 kriegt er sie, der Kurs wär dann aber  sofort wieder bei 0,7€. Grüße Fred
